  • the establishment and payment of all rates of pay or other forms of compensation;

Sexual Harassment Policy

Bank Street College of Education is committed to assuring all staff members a bias-free work environment. Consistent with Bank Street's respect for the rights and dignity of each staff member, sexual harassment will be neither sanctioned nor tolerated. The Equal Employment Opportunity Commission (EEOC) in its 1980 "Guidelines on Discrimination Because of Sex" defined sexual harassment as

unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature... when (1) submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment; (2) submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or (3) such conduct has the purpose or effect of unreasonably interfering with the individual's work performance or creating an intimidating, hostile, or offensive work environment.

Deans, vice presidents, directors, and other supervisory personnel are responsible for assuring that no staff member is subjected to conduct that consitutes sexual harassment.

Any individual found to have engaged in sexual harassment will be disciplined as appropriate, up to and including discharge.

Any individual staff member who feels that he or she has been the subject of sexual harassment may bring the matter ot the attention of the appropriate dean or to the director of Human Resources.

A prompt and thorough investigation of the alleged incident will be conducted by the appropriate dean and/or his or her designee. The individual receiving the complaint should immediately notify the director of Human Resources. The investigation of a complaint and any subsequent action taken in response to the complaint will proceed in confidence to the extent possible.

If either individual feels that the complaint has not been resolved to his or her satisfaction, a formal complaint can be filed with an ad hoc committee or panel appointed by the president. The staff member who believes he or she has been the recipient of sexual harassment may file a complaint with the Equal Employment Opportunity Commission, the New York State Division of Human Rights, or the New York City Commission on Human Rights.

The College will take all appropriate steps to enforce this policy.
